Litigation Update

(2007-08-01) The comprehensive settlement/procedural agreement was finally approved and provides for the co-ordination of proceedings in this matter.

The Ontario class action on behalf of all Canadian investors (including yourselves) will now be proceeding.

In addition, The Bre-X trustee in bankruptcy is pursuing further actions on behalf of investors. No doubt the unfavourable result in the Ontario Securities Commission claim against Felderhof will be a factor considered.

As a result, the Alberta action is now redundant and we will be discontinuing that action as of October 1, 2007 unless we hear from you. At that time we will send our final account for disbursements and will return any outstanding retainers.
