"The Future of Canadian Class Actions" a paper produced by Clint Docken, Q.C.
JAW IMPLANTS
Vitek TMJ implants were introduced in the 1980's and were marked as the end-all for TMJ problems. Unfortunately, the implants broke down after implantation and have caused significant medical problems. We have negotiated settlements for implant victims from the manufacturers and researchers and are pursuing other claims.

BREAST IMPLANTS
We represent over 100 women who have been adversely affected by breast implants. The manufacturers of the implants are Dow Corning, Mentor, Bristol-Myers Squibb, Baxter, Surgitek and McGhan. We have settled a number of claims involving Bristol-Myers Squibb. We are also negotiating settlements for our clients, who have claims against the other manufacturers.

STADOL NS (butorphanol tartrate)
Stadol is a nasal spray which can only be bought in Alberta through prescription. It is normally prescribed to alleviate the symptoms of migraine headaches.

We represent a number of clients who became addicted to Stadol. The allegation being made against Bristol-Myers Pharmaceuticals is that it knew or should have known of the highly addictive qualities of this drug. Despite this fact, it did not give proper warnings on the product itself or to the doctors who prescribed it.

FENFLURAMINE, PHENTERMINE, and/or REDUX
Recent medical studies performed at the Mayo Clinic and published in the New England Journal of Medicine, link the Fen/Phen prescription diet drugs to valvular heart disorder, primary pulmonary hypertension, and bacterial endocarditis. These studies recently led to a recall of the Fen/Phen diet drugs. In addition, the US Government has recommended that anyone who has taken these drugs in any quantity and for any length of time, see their doctor immediately.

Our firm represents clients who took these drugs as diet pills. These clients have developed heart problems which are alleged to have been caused by these drugs.

UNLAWFUL STERILIZATION
In Alberta, until 1972, the Sexual Sterilization Act called for the detention and sterilization of "mentally deficient" individuals at the Alberta Hospital (Edmonton), Alberta Hospital (Ponoka) and the Provincial Training School (Red Deer). We have settled a number of claims for unlawful detention and unlawful sterilization.

HEPATITIS C
Hepatitis C is a disease of the liver, caused by a virus. Its main mode of transmission is through direct contact with the blood of an infected person. Some infected individuals experience fatigue and nausea. In more severe cases, a variety of symptoms may develop that are related to a poorly functioning liver. A significant minority of persons who contract Hepatitis C, die from this disease.

The government has set aside $1.1 billion for the settlement of claims. Negotiations are ongoing.

We represent a number of clients who contracted Hepatitis C through the receipt of "tainted blood". All of our clients received the blood sometime between January 1, 1986 and July 1, 1990.

YBM MAGNEX INTERNATIONAL INC.
In May 1998, the balloon burst on YBM Magnex International Inc., a company trading on the TSE involved in magnets and bicycles, when trading was suspended as a result of accounting "irregularities". We are presently pursuing claims on behalf of investors.
